Upward Extensions Permitted Development - August 2020
A new permitted development right has been introduced since the 1st August 2020 that allows up to two additional storeys on an existing flatted residential building. To qualify, the building must have been constructed between 1st July 1948 - 5th March 2018. To qualify buildings must be:
- Free Standing and purpose built as flats.
- Three storeys or above
- Including any extensions, no taller than 30 metres.
- Floor to ceiling heights must not exceed those of the existing building or 3 metres in height.
DEVELOPMENT IS NOT PERMITTED IN CERTAIN LOCATIONS
- Heritage buildings, Grade listed buildings or land within its curtilage.
- Statues / monuments. Scheduled monuments or land within its curtilage
- Natural reserves & sites of special scientific interest.
- Dangerous sites & areas with safety hazards
- Land within 3 kilometres of the perimeter of an airfield.
What is needed to submit an application?
The legislation sets out the requirements in terms of what needs to be submitted to the Local Authority. Architect7 can help building owners understand the planning policies around upward extensions and can submit Permitted Development applications.
How much do architects charge?
On average, a traditional practice will charge between 5% - 10% of the project cost.
This is the full amount that you will expect to pay. Throughout the whole build. Even the communication and support is included in the architects fees for any project from drawings to build completion.

How are planning applications decided?
After we have submitted your planning application to the local the borough authority the planning officers will check that all the required information has been received.
Most applications are fairly straight forward and will be decided by officers. The local authority planning department will base its decisions on so-called “material considerations,” including:

- Impact on neighbours, loss of sunlight or overlooking

- Noise
- Impact on listed buildings and conservation areas
